These Terms and Conditions (“Terms”) govern your use of the Sendeink platform (“Service”) operated by Sendeink (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Description of Service

Sendeink is a subscription-based software-as-a-service (SaaS) that allows users to convert and send web articles to E-Ink readers. The Service is accessible at https://sendeink.com. We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use Sendeink. By using the Service, you represent and warrant that you meet this requirement.

3. Account Registration

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at support@sendeink.com if you suspect unauthorized use.

4. Subscription and Payment

Sendeink operates on a subscription model with a 14-day free trial. Continued use after the trial requires a valid payment method.

4.1 Billing

By subscribing, you authorize us to charge your payment method automatically according to your selected plan and billing cycle.

4.2 Refunds

Refunds are allowed in accordance with our Refund Policy. Users may request a refund within a reasonable period if they encounter issues or are dissatisfied with the Service.

4.3 Cancellation

You may cancel your subscription anytime through your account settings. After cancellation, you will retain access until the end of the current billing period.

5. User Content

Users may upload or submit content (e.g., URLs, articles) to the Service. You retain ownership of your content but grant Sendeink a non-exclusive, royalty-free license to process and deliver the content solely for the purpose of providing the Service.

6. Prohibited Activities

You agree not to:

• Use the Service for unlawful purposes;
• Disrupt or interfere with the operation or security of the Service;
• Reverse-engineer, copy, or resell the Service or any portion of it;
• Circumvent payment obligations or usage limits.

7. Intellectual Property

All content, trademarks, software, and other materials related to the Service are owned by Sendeink or its licensors. You may not copy, modify, or distribute any part of the Service without written permission.

8. Service Availability

We strive to maintain continuous access to the Service but do not guarantee uninterrupted operation. Scheduled maintenance or technical issues may cause temporary downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Sendeink shall not be liable for any indirect, incidental, or consequential damages resulting from your use or inability to use the Service. Our total liability shall not exceed the amount paid by you in the three (3) months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service. Upon termination, your right to use the Service will cease immediately.

11. Privacy

Your personal data is handled in accordance with our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR).

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany and the European Union. Any disputes shall be resolved in the competent courts of Germany.

13. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with a revised “Effective Date.” Continued use of the Service constitutes acceptance of the updated Terms.
